7. Criteria for Registration of Design in India

Eligible of design registration the circumstances are following:

1. The design must be a new or original one, and should never seen anywhere else before applying.
2. It should be an outwardly new and original article of manufacture as dictated by the shape, pattern, configuration or ornamentation.
3. The design must be suitable for an industrial-process application (mass production). The definition excludes works of art such as paintings or sculptures.
4. It should show when the article is pasted on.
5. It shall not be contrary to public order or law.
6. Design needs photots from all angles.

2. Illustrations or representations of the article in several views
3. A novelty statement about what makes the design special
4. Letter of Authorisation (for individual using an agent)
5. Images of the design from all angles

Design Registration Process in India

Application Filing

1. Complete the design registration form with full particulars.
2. Include the views of the design in every single plan or drawing.

4. If an agent is acting on your behalf, a power of attorney must be supplied.

Examination

The application is scrutinised by the Patent Office. In case of discrepancies or objections, you are required to rectify and resubmit it within prescribed time.

Acceptance

If all is in order, the application is accepted and published in the Patent Office Journal.

Certificate Issuance

Once registered the design is secure and an official Design Registration Certificate will be granted.
